Terms and Conditions

1. General

Unless expressly agreed otherwise in writing, the following conditions apply to all our reservations and services.

2. Definitions

The following is always understood by the following words.


2.1 Hotel Oudegracht
Hotel Oudegracht, Chamber of Commerce Central Netherlands, Chamber of Commerce number 30247939, location number 000034723196


2.2 Service
The provision by Hotel Oudegracht of accommodation and/or food and/or drink and/or making available (room) space, everything with all associated activities and services and everything in the broadest sense of the word.


2.3 Reservation Value
The total turnover expectation of Hotel Oudegracht with regard to this agreement, which expectation is based on the prices applicable within Hotel Oudegracht, as stated in the confirmation drawn up by us. If, at the time of cancellation, certain parts of the agreement as stated in the confirmation are not yet fully known, we will charge a minimum reservation value.


2.4 Cancellation
The notification by e-mail by the guest to Hotel Oudegracht that one or more agreed services will not be used in whole or in part.


2.5 No show
Failure by a guest to use a service to be provided under this Agreement without cancellation.

3. Conclusion of agreement

All offers and quotations made by Hotel Oudegracht are without obligation and subject to change, unless otherwise agreed in writing or verbally. Reservation is only possible online via  www.hoteloudegracht.nl . The agreement is concluded with the sending of the reservation confirmation by Hotel Oudegracht.

 

Hotel Oudegracht has the right to refuse guests access to the hotel as well as the provision of services if, in its opinion, normal/orderly business operations require this. This also includes failure to comply with the House Rules or failure to follow directions from one or more representatives of Hotel Oudegracht, for example in the event that guests cause (noise) nuisance to local residents.  

4. Payment and Cancellation

4.1 Payment method
All payments must be made by bank or credit card. Cancellation must be made in writing and dated (by e-mail).


4.2 No show
In the event of a no-show, the guest will in all cases be obliged to pay the reservation value, at the latest on the date of Arrival ('Effective Date') stated in the reservation confirmation.


4.3 Cancellations
The following applies to cancellation of the reservation:

 

4.3.1 'Best Flexible Rate'; payment no later than the Effective Date
a. In the event of cancellation more than 72 hours before the commencement date, the guest is not obliged to pay any compensation to Hotel Oudegracht.
b. In the event of cancellation less than 72 hours before the commencement date, the guest is obliged to pay Hotel Oudegracht a fee of 100% of the reservation value.
c. For the purposes of a. and b. of this article, the day of arrival starts at 00:00.

 

4.3.2 'Lowest Non Refundable Rate'; on-line payment when booking
Cancellation is not possible, payments are non-refundable.

5. Late payment

a. If and insofar as timely payment is not made by the guest, he is in default without any notice of default being required. In that case, he must reimburse Hotel Oudegracht for all judicial and extrajudicial costs associated with the collection. The extrajudicial costs are set at a minimum of 20% of the principal sum with a minimum of € 150.00, which is to be increased with VAT.


b. If the guest is in default, he must continue to pay Hotel Oudegracht the interest on the amount owed equal to 2% above the statutory interest. Part of the month is counted as a whole month when calculating the interest. Finally, Hotel Oudegracht has a right of retention on all items that are present in the hotel by or on behalf of the guest.
 

6. Liability

Hotel Oudegracht is not liable for injury to guests. Hotel Oudegracht is also not liable for damage or loss of goods brought into Hotel Oudegracht by a guest. The guest indemnifies Hotel Oudegracht against claims from guests in this regard. The foregoing does not apply insofar as the damage or loss and/or injury is due to intent or gross negligence on the part of Hotel Oudegracht. The guests are jointly and severally liable for all acts of one of them that lead to damage or loss of goods and/or injury to Hotel Oudegracht, persons who work on behalf of Hotel Oudegracht and/or third parties, as well as for all damage caused by any animal and/or any substance and/or any thing in their possession or under their control.

The Uniform Conditions Horeca also apply to all reservations.
